How would you define the role that a lawyer in your specialty should have with the companies they represent?
In the field of intellectual property, I believe that the role of a lawyer with the companies they represent is that of a strategic advisor and protector of intangible assets. This involves not only providing solid and expert legal advice on intellectual property matters, but also deeply understanding the client’s business and its long-term objectives.
As a lawyer, my goal is to be a strategic partner for our clients, working closely with them to mitigate risks, identify opportunities, protect their rights and interests, and help them achieve their business goals.
During your professional practice, what are the most common mistakes you have seen in this field?
The mistakes vary, from entrepreneurs who create and use a logo similar or identical to a registered trademark in the same line of business, to clients who import goods from a popular Asian platform without realizing that the design is protected by copyright. In both cases, intellectual property rights are infringed. Therefore, it is essential to have specialized advice beforehand.
The key point lies in obtaining expert guidance to prevent contingencies or to develop a strategy for protecting a company’s intangible assets, such as trademarks, patents, and copyrights.
What role does intellectual property play in companies?
Intellectual property plays a fundamental role in companies because, by protecting their intangible assets (such as inventions, industrial designs, distinctive signs, works, and trade secrets), it grants exclusivity over their creations.
Undoubtedly, such protection fosters innovation and allows companies to compete more effectively in the market by differentiating their products and services. In addition, intellectual property can be a source of revenue through licensing, sales, and collaboration agreements, thereby contributing to the company’s commercial value and growth.
How can this field evolve with artificial intelligence?
Artificial intelligence is transforming intellectual property by automating processes such as patent searches, copyright infringement analysis, and intellectual property portfolio management. It also raises new legal and ethical challenges, such as the protection of copyright in AI-generated works and the proper attribution of authorship. In the future, AI is expected to improve efficiency and accuracy in intellectual property management, but it will also require continuous adaptation of laws and regulations to address its unique implications.
