What motivated you to specialize in areas such as criminal, civil, and corporate law, and how do you believe this combination benefits your clients?
What do you consider to be the key to protecting the assets and continuity of a company or family in the face of a complex legal environment?
I believe that one must anticipate potential conflicts that may arise among family members, partners, and shareholders, and based on that, establish sound agreements and appropriate clauses that, in the event of a future dispute, allow for an amicable resolution without affecting the continuity of the company or, where applicable, the family’s assets.
Today, prevention is essential. How does a culture of compliance help prevent a commercial or civil issue from becoming a criminal risk?
Having a compliance program within an organization contributes in two fundamental ways: first, by strengthening the organization’s reputation; and second, by implementing internal mechanisms in areas that interact with the organization’s stakeholders, helping prevent civil and even criminal disputes. In addition, having such a program may mitigate or exempt companies and their directors from criminal liability.
